This appeal is taken by the defendant-appellant, Max S. Elbaum, from a judgment and sentence after conviction of a violation
of sec. 940.205, Stats., battery to a peace officer. The defendant was tried and found guilty of this offense on April 12,
1971, and on June 30, 1971, he was sentenced to two years in the state prison, but execution of the sentence was stayed and
he was placed on probation for two years. This offense is a felony. Prior thereto, on October 20, 1970, the defendant Elbaum was convicted of a violation of sec. 946.41, Stats., resisting or
obstructing an officer, a misdemeanor, and sentenced to pay a fine of $100 and costs, or in default thereof, to be confined
for ninety days. This conviction was not appealed.
