Eminent domain -- enlargement of proceeding -- delegation of power. When the state institutes a condemnation for a right of way for a trunk highway under art. 16 of the constitution, by a procedure
fixed by the general highway act and the general condemnation statute, and omits to include a tract of land which it uses
and damages as a part of the general project, the owner upon a proper showing may have such land included in the condemnation
proceeding to the end that there may be an assessment of damages; and this is not prevented because the state cannot be sued
nor because the defendant might petition the legislature for compensation.
